Fair Use Policy

This Fair Use Policy (FUP) applies to all Users of PowerDMARC including without limitation Partners (Managed Service Providers (MSP), Managed Security Service Providers (MSSP), Resellers, Domain & Hosting Providers), Partner’s End Users, PowerDMARC Direct Customers, Enterprise Clients and any other Party using the Services directly or in-directly using PowerDMARC platform, (“Users”, “You” or “Your”). This Policy governs all access to and use of the Services Provided by PowerDMARC (“PowerDMARC”, “we”, “Us” or “our”) unless otherwise explicitly specified in writing.

1. Purpose

The purpose of this FUP is to ensure that all Users use our platform, services, api, and any related Services in a fair, responsible, ethical, legal, and non-abusive manner and in a way that does not affect our platform performance and security.  

2. Fair Use Standards: 

2.1. General Standard: You must use the Services in a fair, reasonable, responsible, and lawful manner, consistent with the intended purpose of the Services and the Agreement.

2.2. Normal Usage: Your use must remain within levels that the Company reasonably determines to be normal and customary for your applicable plan or license, considering user cohorts, plan descriptions, historical usage, and technical capacity.

3. Prohibited Usage Categories:

3.1. Non‑Compliant Use: Usage will be deemed outside fair use if, in the Company’s reasonable judgment, it meets any of the following definitions, including, without limitation:

3.1.1. Extraordinary Use:

3.1.1.1. materially exceeds what is typical for a comparable business, plan tier, or license; 

3.1.1.2. degrades or threatens the performance, availability, integrity, or security of the Services; 

3.1.1.3. imposes unreasonable or disproportionate costs or burdens on the Company or

3.1.1.4. is inconsistent with the intended purpose or documented scope of the Services under the applicable Agreement.

3.1.2. Excessive Use: Sustained, repeated, or disproportionate consumption of resources (including compute, storage, API calls, email traffic, query volume, bandwidth, or similar) that materially impacts or creates a material risk of impacting service quality, performance, or availability for others’ use.

3.1.3. Abusive Use: Any use that is unlawful, fraudulent, deceptive, or harmful, including, without limitation:

3.1.3.1. sending spam or unsolicited bulk communications; phishing; spoofing; or email authentication/policy violations;

3.1.3.2. security violations, probing, scanning, interference with or disruption of the Services;

3.1.3.3. regulatory or policy breaches, violations of data protection, anti‑spam, or export laws;

3.1.3.4. circumvention, disabling, or tampering with technical or administrative controls, rate limits, or metering, or

3.1.3.5. infringement, misappropriation, or any other violation of third‑party rights.

3.1.4. Improper Use: Use outside the agreed scope, license metrics or reasonable business purpose under the applicable Agreement or Documentation, including without limitation:

3.1.4.1. use beyond licensed domains, users, seats, or permitted volumes;

3.1.4.2. resale, redistribution, sublicensing, or service‑bureau activity not expressly permitted;

3.1.4.3. automated scraping, bulk data extraction, or use of bots in a manner inconsistent with the Services’ intended purpose.

4. Continuous Monitoring and Remedies

4.1. We will continuously monitor your use for indicators of  Excessive, Abusive, or Improper Use. 

4.2. If we reasonably determine that you have engaged in Extraordinary, Excessive, Abusive, or Improper Use, we may take reasonable and proportionate steps to protect our platform, customers, and adhere to legal obligations. Such steps may include, without limitation:

4.2.1. Notify you to adjust or reduce the usage.

4.2.2. Offer you to upgrade to a custom licence.

4.2.3. Apply overage charges.

4.2.4. Suspend or, if necessary, terminate the service to protect the Platform.

4.3. If you do not wish to upgrade your licence, then you should reduce your licence usage.
