1. Relationship to the Terms of Service
These AI Terms supplement the PowerDMARC Terms and Conditions, which are incorporated herein by reference. All terms, conditions, disclaimers, limitations of liability, indemnities, data protection obligations and governing law provisions set out in the PowerDMARC Terms and Conditions shall apply fully to the AI Features and these AI Terms, unless expressly stated otherwise. If there is a conflict, these AI Terms shall govern only the AI Features.
2. Definitions
- AI Features: AI-enabled capabilities within PowerDMARC (e.g., explaining findings, summarizing security posture, recommending configuration improvements).
- Customer Data: Data submitted to, stored in, or processed by PowerDMARC as part of providing the services (including domain-related security configuration, telemetry, and related account data).
- Inputs: Data PowerDMARC AI processes to generate an output (including selected-domain data and user-provided prompts/requests).
- Outputs: AI-generated responses, summaries, recommendations, or other results.
- Selected Domains: The specific domains you authorize for AI processing through domain-level selection controls.
- AI Profile: The AI-related configuration and context derived from Customer Data for the purpose of generating Outputs for your enabled AI Features.
3. Opt-in, Consent, and Domain-Level Scope
- 3.1. Opt-in required. PowerDMARC AI will process Customer Data for AI Features only if you explicitly enable AI and accept these AI Terms within the product.
- 3.2. Domain-level selection. You control which domains are included. AI processing is limited to Selected Domains authorized by you.
- 3.3. Authorized users. You are responsible for ensuring only authorized users enable AI and manage domain selection.
4. Purpose Limitation and Data Minimization
- PowerDMARC processes Inputs only to provide the AI Features you have enabled, and only to the minimum extent necessary to deliver those AI Features.
5. Hosting and Infrastructure
- PowerDMARC operates and hosts the AI Features within PowerDMARC-controlled infrastructure. Customer Data processed for AI Features is processed within PowerDMARC’s environment and is not shared with external AI service providers for model hosting or inference, except as required to operate the services or as otherwise authorized by the customer in writing.
6. Training and Improvement
- 6.1. No training on Customer Data by default. PowerDMARC will not use Customer Data to train or fine-tune general-purpose models made available to other customers unless you explicitly opt in or agree in writing.
- 6.2. Service quality. PowerDMARC may use aggregated usage analytics and operational telemetry to maintain and improve the services (including AI safety monitoring), consistent with applicable law and the Privacy Policy.
7. Output Disclosures and Limitations
- 7.1. Advisory only. Outputs are generated automatically and are provided for informational purposes. You are responsible for validating Outputs before implementing security changes.
- 7.2. No warranties on Outputs. Outputs may be incomplete, inaccurate, or not up to date. PowerDMARC does not guarantee Outputs will detect every issue or prevent incidents.
- 7.3. No prohibited reliance. You must not use AI features in ways that require regulated determinations about individuals (e.g., employment, credit, eligibility decisions) or other uses that are restricted or regulated under applicable law. (Annex III of the EU AI Act lists categories typically treated as high-risk.)
8. Acceptable Use
- You will not:
- Use AI Features to generate, facilitate, or promote unlawful content or harmful activity.
- Attempt to extract model parameters, reverse engineer, or bypass security controls.
- Submit sensitive personal data beyond what is necessary for the AI Feature.
9. Intellectual Property
- 9.1. Customer Data. As between the parties, you retain rights to Customer Data.
- 9.2. Outputs. As between the parties, you may use Outputs internally for your business purposes, subject to these AI Terms and the Main Terms.
- 9.3. PowerDMARC IP. PowerDMARC retains all intellectual property rights to the services, models orchestration, prompts, workflows, and software.
10. Security
- PowerDMARC maintains administrative, technical, and physical safeguards designed to protect Customer Data processed by AI Features.
11. “Forget my profile” and Deletion
- 11.1. Disable AI. You may disable AI Features at any time.
- 11.2. Forget my profile. If you request “Forget my profile,” PowerDMARC will remove your AI Profile and delete Customer Data previously used for AI insights so it is no longer available for AI Features for your account, subject to limited retention required for legal compliance, security, fraud prevention, dispute resolution, or backup integrity.
12. Termination
- Upon termination or expiration of the Main Terms, your rights to use AI Features end.
13. Changes
- PowerDMARC may update these AI Terms from time to time. Material changes will be communicated through the platform or via reasonable notice.
